- User Accounts and Responsibilities
1.1 Account Creation: 1.1.1 To access the features of the After5 mobile app ("the App"), users must create an account by providing accurate and current information, including their full name, phone number, profile photo, and age. 1.1.2 Users affirm that the information provided during account creation is truthful and agree to adhere to the age restrictions outlined in section 1.3.
1.2 Account Security: 1.2.1 The App utilizes phone number authentication as a replacement for passwords. 1.2.2 Users are responsible for the security and privacy of their phone number and any related access codes. 1.2.3 Users agree not to share their account details or permit others to use their account.
1.3 User Age and Children's Privacy: 1.3.1 During account creation, users must accurately disclose their age. 1.3.2 The App strictly adheres to age restrictions in accordance with the lawful drinking age in the user's location. 1.3.3 Users below the age of 18 are subject to specific limitations, including the inability to use drinking-related emojis. Additionally, certain information, such as drinking-related emojis, will not be visible to users under 18 when interacting with friends over 18.
1.4 Sharing Information with Friends: 1.4.1 By using the After5 mobile app, users acknowledge that certain information, including their phone number, profile photo, name, username, and status, will be automatically shared with friends they connect with on the app. 1.4.2 This sharing of information is essential for facilitating user interactions within the App, allowing friends to contact each other and engage in a personalized social experience. 1.4.3 Users have the option to manage their sharing preferences within the App's settings or privacy controls.
1.5 Account Termination: 1.5.1 Users wishing to deactivate their account should send an email to [email protected], including their account details and a request for account termination. 1.5.2 Upon receipt of the email, the account termination request will be processed within a reasonable period. 1.5.3 Following account termination, user data and related content will be permanently deleted, unless the preservation of certain data is required by applicable laws or regulations.
1.6 Account Deactivation: 1.6.1 In cases of prolonged inactivity or violation of these Terms, we reserve the right to deactivate or delete user accounts, including any associated content, without prior notice.
- User Content and Conduct
2.1 User Content: 2.1.1 Users are only allowed to upload a profile picture to represent their account on the App. No other forms of content posting or sharing are permitted. 2.1.2 Profile pictures must adhere to the following limitations:
- Size: 250 x 250 pixels
2.2 Prohibited Conduct: 2.2.1 Users are strictly prohibited from engaging in any activities or behaviors that are illegal or violate applicable laws and regulations. 2.2.2 The App does not allow the posting, sharing, or transmission of any content that is defamatory, offensive, discriminatory, or harmful.
2.3 Consequences of Misconduct: 2.3.1 Users are encouraged to report any abusive or inappropriate behavior by contacting us via email at [email protected]. 2.3.2 Upon receiving reports of abuse or inappropriate conduct, we will promptly investigate the matter and take appropriate action, including content removal, account suspension, or termination, as deemed necessary.
2.4 Moderation and Content Review: 2.4.1 We perform checks on the profile photos uploaded by users to ensure compliance with the established guidelines. 2.4.2 While we strive to maintain a safe and respectful environment, it is possible that some content may evade our initial review. We rely on users to report any content that violates the Terms of Use, and upon receipt of such reports, we will promptly investigate and take necessary actions to remove the reported content.
- Privacy and Data Collection
3.1 Data Collection: 3.1.1 By using the After5 mobile app ("the App"), users acknowledge and agree that we collect and process certain personal data in accordance with our Privacy Policy. 3.1.2 In addition to the full name, phone number, profile photo, and age, we also collect the user's status as part of their profile information.
3.2 Data Usage: 3.2.1 We collect user data with the sole purpose of providing benefits and enhancing the user experience within the App. 3.2.2 The data we gather, including location information, is used to improve the functionality, features, and user experience of the App.
3.3 User Benefits: 3.3.1 Our primary objective is to provide maximum benefit to our users. Any data collected will only be utilized if it can provide additional benefits to users within the App. 3.3.2 We do not engage in targeted advertising on the App.
3.4 Data Protection and Security: 3.4.1 We are committed to protecting the privacy and security of user data. We comply with applicable data protection laws, including the General Data Protection Regulation (GDPR). 3.4.2 We conduct regular security assessments and audits to identify and address any vulnerabilities that could compromise the security of user data.
3.5 User Rights: 3.5.1 Users have the right to access, correct, update, or request the deletion of their personal data. To exercise these rights, users can contact us via email at [email protected]. 3.5.2 Upon receiving such requests, we will promptly respond and take the necessary steps to fulfill the user's data-related inquiries or deletion requests.

- Intellectual Property
4.1 Ownership: 4.1.1 All intellectual property rights related to the After5 mobile app ("the App"), including but not limited to trademarks, logos, and content, belong to us or our licensors. 4.1.2 Your use of the App does not grant you any rights or licenses to our intellectual property.
4.2 Prohibited Use: 4.2.1 You agree not to use, copy, reproduce, modify, or distribute any App content without our explicit written permission. 4.2.2 Any unauthorized use of App content is strictly prohibited and may result in legal consequences.
- Termination
5.1 Termination by Us: 5.1.1 We reserve the right to suspend or terminate your account and deny access to the After5 mobile app ("the App") at our discretion, with or without cause. 5.1.2 In the event of termination, we may provide notice to you via email or within the App, stating the reason for termination, unless prohibited by law.
5.2 Termination by You: 5.2.1 You have the right to terminate your account at any time by following the instructions provided within the App. 5.2.2 Upon termination of your account, you will no longer have access to the App, and your account data will be permanently deleted, except as otherwise required by applicable laws or regulations.
- Limitation of Liability and Disclaimers
6.1 Use at Your Own Risk: 6.1.1 The After5 mobile app ("the App") is provided on an "as is" basis, without warranties of any kind, whether express or implied. 6.1.2 You acknowledge and agree that your use of the App is at your own risk. We make no guarantees regarding the availability, accuracy, or reliability of the App or its features.
6.2 Limitation of Liability: 6.2.1 We shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from your use or inability to use the App. 6.2.2 This includes, but is not limited to, damages for loss of profits, data, or other intangible losses. 6.2.3 To the maximum extent permitted by applicable law, our total liability to you for any claims arising out of or relating to the App shall not exceed the amount you paid, if any, for accessing or using the App.
6.3 No Liability for Third-Party Actions: 6.3.1 We disclaim any responsibility or liability for the actions, content, or services provided by third parties that may be accessed through the App. 6.3.2 Any transactions, interactions, or engagements with third parties are solely between you and the third party, and we shall not be held liable for any resulting damages or losses.
6.4 Legal Disclaimer: 6.4.1 The information provided within the App is for general informational purposes only and does not constitute professional advice. 6.4.2 We do not guarantee the accuracy, completeness, or usefulness of any information or content within the App. 6.4.3 You should seek professional advice or conduct your own research before relying on any information or content provided within the App.
- Modifications to the Terms of Use
7.1 Modifications: 7.1.1 We reserve the right to modify these Terms of Use at any time, with or without prior notice. 7.1.2 We will make reasonable efforts to notify you of any material changes to the Terms through the App or by other means, such as email or push notifications. 7.1.3 It is your responsibility to review the updated Terms and ensure your ongoing compliance with them.
7.2 Acceptance of Changes: 7.2.1 Your continued use of the After5 mobile app ("the App") after modifications to the Terms indicates your acceptance of the updated Terms. 7.2.2 If you do not agree with the modified Terms, you must discontinue using the App and terminate your account as outlined in Section 5 (Termination).
7.3 Severability: 7.3.1 In the event that any provision of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
- Governing Law and Jurisdiction
8.1 Governing Law: 8.1.1 These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of laws principles. 8.1.2 Any disputes arising under these Terms or in connection with the After5 mobile app ("the App") shall be resolved in accordance with the laws of England and Wales.
8.2 Jurisdiction: 8.2.1 Any legal action or proceeding arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in England and Wales. 8.2.2 You agree to submit to the personal jurisdiction of such courts for the purpose of litigating any such action or proceeding.
8.3 International Users: 8.3.1 If you access or use the App from outside England and Wales, you are responsible for complying with the laws and regulations of your jurisdiction.
- End-User License Agreement (EULA)
9.1 Objectionable Content and Abusive Users: 9.1.1 There is zero tolerance for objectionable content or abusive users on the App. 9.1.2 Users who encounter any form of objectionable content or abusive behavior are urged to report such incidents immediately. 9.1.3 Reports can be made through the help page on the App. Detailed instructions for reporting can be found by following the steps on the help page.
9.2 Reporting Procedure: 9.2.1 Users should navigate to the help page within the App to report any objectionable content or abusive users. 9.2.2 After following the instructions on the help page, users can email the report to [email protected]. 9.2.3 Our team will investigate all reports promptly and take necessary action, including but not limited to content removal, account suspension, or termination, to ensure the App remains a safe environment for all users.
